PATENT
Patent shall mean an exclusive right granted by the State to an Inventor for his Invention in the filed of technology, for a certain time, to exploit his Invention or to authorize another person to exploit it.
Invention shall mean an Inventor’s Idea that is poured in any activity of solving a specific problem in the field of technology, either in the form of product or process, or an improvement and development of a product or a process.
Inventor shall mean a person or several persons acting together implementing an idea poured in an activity resulting in an Invention.
Patent Holder shall mean an Inventor as the owner of Patent or a recipient of such right from the owner of Patent or a subsequent recipient of Patent from the person mentioned above who is registered in the General Register of Patents.
A Patent shall be granted to an Invention, which is novel, involves an inventive step and is susceptible of industrial application.
A. Documents Required for Filing a Patent Application
Basic Requirements:
a. Complete data of the Inventor(s) and the Applicant.
b. A simply signed Power of Attorney by the Applicant.
c. Where the applicant is not the author/creator(s), an assignment document signed by both parties is required.
d. Patent specification, claims and abstract in English.
e. Drawings (if any).
Additional documents for convention patent application:
a. Copy of filing receipt of the first patent application.
b. The priority document with certified English translation.
Additional documents for Entry of PCT National Phase in Indonesia:
a. Simple copy of the PCT request form PCT/RO/101. (Indonesia (ID) has to be clearly designated therein).
b. WIPO Publication.
c. International Search Report.
d. A copy of any amendment lodged at the International Bureau and any other correspondence between the applicant and the International Bureau (if any).
B. Documents Required for filing a Simple Patent (Utility Model) Application:
Basic Requirements:
a. Complete data of the Inventor(s) and the Applicant.
b. A simply signed Power of Attorney by the Applicant.
c. Where the applicant is not the author/creator(s), an assignment document signed by both parties is required.
d. Patent specification, claim and abstract in English.
e. Drawings (if any).
